Some differences in fiqhi issues - Imam Albani رحمه الله

بسم الله الرحمن الرحيم 

The muhaddithul 'asr, Imam us-Sunnah , mujaddid ud-Da'wah, Muhammad NasirudDeen al-Albani رحمه الله رحمة واسعة had differed with the other great Salafi scholars رحمهم الله جميعا in some fiqhi issues :-

For eg :

1. Second Jama'ah in masjid
2. I'tikaaf in other than the 3 masajid
3. Obligation of Covering the face for women
4. Placing the hands on the chest after raising from ruku'
5. Shaking the index finger in tashahhud
6. Voluntary fasts on saturdays
7. Increasing the number of Raka'ah for Salatut Taraweeh beyond 11/13
8. Qiyam ul Layl in the last part of the night in addition to the taraweeh in the 1st part.
9. Trimming off from the beard after a fist's length.

10. Hitting the children below the age of 10....
11. Universal Moon sighting for all the countries
12. Father taking his young kids (below7) to the msajid
13. Ma'moom Recting Suratul Fatiha along with Imam in Salah Jahriyya
14. Praying behind the grave worshippers / sufis (before establishing the proofs)...
15. Wujoob of Women attending the Musallah -al'Eed...
16. Salatut Tasabeeh
17. Holding the Mushaf when reciting in Qiyamul Layl...
18. Drinking water while standing...
19. bathing twice on day of jumu'ah if in a state of janabah. etc.
20. Raising the hands for the Takbeerat other than 1st takbeer in Salatul Janaza
21. Paying off Obligatory Zakah on the Commodities / stock value of business merchandise
22. Women wearing Gold ornaments in the form of ring shape 
23. making up the missed/lost obligatory fasts of Ramadhan in Shawwal combining with 6 voluntary fasts of Shawwal

etc. etc.
وما ذكره أخونا في الله العلامة الشيخ: محمد ناصر الدين الألباني في كتابه: (آداب الزفاف) من الجمع بينها وبين أحاديث الحل بحمل أحاديث التحريم على المحلق، وأحاديث الحل على غيره غير صحيح وغير مطابق لما جاءت به الأحاديث الصحيحة الدالة على الحل؛ لأن فيها حل الخاتم وهو محلق وحل الأسورة وهي محلقة، فاتضح بذلك ما ذكرنا؛ ولأن الأحاديث الدالة على الحل مطلقة غير مقيدة، فوجب الأخذ بها لإطلاقها وصحة أسانيدها، وقد تأيدت بما حكاه جماعة من أهل العلم من الإجماع على نسخ الأحاديث الدالة على التحريم كما نقلنا أقوالهم آنفا، وهذا هو الحق بلا ريب.
وبذلك تزول الشبهة ويتضح الحكم الشرعي الذي لا ريب فيه بحل الذهب لإناث الأمة، وتحريمه على الذكور. والله ولي التوفيق والحمد لله رب العالمين وصلى الله على نبينا محمد وعلى آله وصحبه وسلم[1].

But it should be understood here that Khilaaf is of various types & one amogst them is Khilaaf ut Tafaahum which is tolerable. Whereas the  'Aqeedah & Manhaj of all our Imams are the same. May Allah have mercy on us.  إنه غفور رحيم


اختلف العلماء في هذه المسأله فيري الشيخ ابن باز وسائر علماء المملكه علي انه يرفع يديه في كل تكبيره اما الشيخ الالباني فيري انه يرفع يديه في التكبيره الاولي فقط وهذا من مسائل الاختلاف وما وسعهم الخلاف فيه وسعنا .

قال الإمام ابن المنذر في "الإشراف" (2/359) :

🍃حكم ضرب الأولاد🍃



هل يجوز ضرب الطفل إذا أخطأ وهو صغير وهل يؤثر هذا الضرب على نفسية الطفل وكيف يكون توجيه الطفل في مثل هذه المرحلة.

الجواب: إذا كان الطفل يتأدب بالضرب ولم يكن بد منه فلا بأس به وقد جرت عادة الناس على هذا وإذا كان لا يتأدب كطفل في المهد جعل يصيح فتضربه أمه مثلاً فهذا لا يجوز لأن فيه إيلاماً بلا فائدة والمدار كله على هل هذا الضرب يتأدب به الطفل أو لا يتأدب وإذا كان يتأدب به فلا يضرب ضرباً مبرحاً ولا يضرب على الوجه مثلاً ولا على المحل القاتل وإنما يضرب على الظهر أو الكتف أو ما أشبه ذلك مما لا يكون سبباً في هلاكه والضرب على الوجه له خطره لأن الوجه أعلى ما يكون للإنسان وأكرم ما يكون على الإنسان وإذا ضرب عليه أصابه من الذل والهوان أكثر مما لو ضرب على ظهره ولهذا نهي عن الضرب على الوجه.

The ’Allaamah, the Muhaddith of Medinah, the Shaikh ’Abdul-Muhsin al-’Abbaad, may Allaah the Most High protect him, said, “Al-Albaani in our time is like [Imaam] Ahmad in his.” Al-Imaam al-Albaani, Shaikhul-Islaam wa Imaamu Ahlis-Sunnah wal-Jamaa’ah fi ’Uyoon A’laam al-’Ulamaa wa Fuhool al-Udabaa, p. 223.





Shaikh Saalih as-Suhaimi, may Allaah protect him, said, “So it is not allowed to be bigoted for personalities nor to consecrate them—men are known by the truth, it is not the truth which is known by men.
And there is a situation that occurred which I will relate about our Shaikh, Shaikh Muhammad Naasirud-Deen al-Albaani, may Allaah have mercy on him, when I visited him just before his death by about a month and a half.
After I gave him salaam some of the brothers introduced me to him, so he said, ‘You’re introducing him to me, the disputant concerning fasting on Saturday and praying more than one Jamaa’ah [in a mosque]?’
So I said to him, ‘O Shaikh of ours! I still hold that opinion, I hold it to be permissible to repeat the congregational prayer more than one time and I still hold the legitimacy of fasting on Saturday as long as a person doesn’t single it out alone as the day to be fasted on, in opposition to you—and you are the one who taught us this, O Shaikh of ours.
So he tightened his grip on my hand, may Allaah have mercy on him, and I have never forgotten the pull of his hand at that moment, and said, ‘This is how we want the students of knowledge to be—not being bigoted towards me nor others—so may Allaah reward you with good.’
And I attended a debate between him and our Shaikh, Shaikh ’Abdul-Muhsin al-’Abbaad al-Badr where each one of them revered the other, [the debate being] about cutting off more than a fistful of the beard which was the opinion Shaikh al-Albaani held based upon the narration of ’Abdullah ibn ’Umar, so we enjoyed this debate for about two hours, with each of them, both our Shaikh, Shaikh ’Abdul-Muhsin al-’Abbaad al-Badr and our Shaikh, Shaikh Muhammad Naasirud-Deen al-Albaani, respecting each other [throughout].
And when Shaikh Muhammad Naasirud-Deen al-Albaani met our Shaikh, Shaikh Humood at-Tuwaijiri, may Allaaah have mercy on him, [prior to which] there had been strong rebuttals [between them] concerning the issue of the hijaab, when they met they honoured one another and when a question was put forth each one of them would refer it to the other.
‘These are my forefathers so bring me their likes
When, O Jarir, the places of assembly bring us together.’


These are the peerless scholars who left, and a huge breach was created because of their departure."
 لقد أجمع علماء الأمة على أن عروض التجارة فيها زكاة، وقد خالف في ذلك الشيخ الألباني رحمه الله ولا أعلم أحدا خالف في ذلك قبله، فإنه نشر في بعض تعاليقه أن زكاة العروض لا تجب وليس فيها زكاة واجبة وليس عليهم إلا أن يتصدقوا تبرعاً فخالف بذلك الإجماع.
وسبب ذلك أنه تكلم على حديث سمرة الذي رواه الحسن عن سمرة: كنا نعد الزكاة من كل شيء نعده للبيع.
فلما لم يكن الحديث صحيحاً على شرطه، فقال بعدم وجوب الزكاة في عروض التجارة، وكأنه لم يطلع على أحاديث أخرى دليل على زكاة العروض، فقال الشيخ الألباني رحمه الله: إذا لم يثبت هذا الحديث، فإنه لم يثبت في العروض حديث، ولهذا فإنه لا زكاة فيها، ومن أراد أن يتصدق تطوعاً وإلا فلا.... إلى آخر تلك الفتوى.
